    A video for UK law students studying theft. Theft is defined under s. 1(1) of the Theft Act 1968 as "dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it" and contains five key elements: dishonesty, appropriation, property, belonging to another and intention to permanently deprive. This lecture looks at all five elements by splitting them up into the actus reus and the mens rea of the crime. Appropriation means taking and this only needs to be a right; not all of the rights associated with property (Morris [1984]). Appropriation can even take place with consent or with title to the property since Gomez [1993] supported in Hinks [2000]. This is controversial and arguably diminishes the importance of the actus reus in theft. ...

This is controversial and arguably diminishes the importance of the actus reus in theft. Theft is also a finite act per Atakpu [1994] so a person can only be convicted on appropriation. However it will not be theft when the defendant is a bona fide purchaser. Property is defined broadly and can include things in action (Kohn [1979]) and other intangible property (A-G of Hong Kong v Chan Nai-Keung [1987]) Belonging to another is normally obvious to see in a theft case but there are some unusual cases (Marshall [1998] and Turner (No. 2) [1971]) including where property is received for a particular purpose and where property is received by mistake (A-G’s Reference (No. 1 of 1983) [1985]). Dishonesty is defined in s. 2 but the main test comes from Ghosh [1982] and includes both an objective and subjective element. This has been subject to criticism over the years but is still good law. Finally intention to permanently deprive also has been given a broad interpretation by the courts to include a range of scenarios including ransom (Hall [1849]), property in a different form, (Richards [1844]) and pawning (Phetheon [1840]). Section 6(1) also deals with situations where property is taken “for a period…making it equivalent to outright taking”.

The Honda Hornet motorcycle was stolen from East London but luckily for the owner, it was fitted with a TRACKER. Once the TRACKER unit was activated, patrolling officers in Edmonton picked up its silent signal coming from a commercial premise. Inside the premises, officers found the stolen Honda Hornet and a stolen Honda CBR 1000RR motorcycle, together with the parts of several dismantled bikes. Two people were arrested and are subject to an ongoing investigation. Adrian Davenport, Police Liaison Manager from TRACKER says, “Motorcycle theft in the UK is a big problem, with Greater London having the most incidents. There is a growing trend in motorcycles being stolen by highly organised teams who either break them up for parts that then get sold via the internet, or for export. Larger engine ‘Superbikes’ are particularly attractive to these teams, but all bike owners need to take the right security precautions. Fitting a TRACKER product to your motorcycle can significantly increase the chances of police locating it if it is stolen. “Luckily the owner of the Hornet had fitted one of our products which led to its swift recovery, alongside other stolen items, as well as the arrest of two individuals. That it is not in the case with motorcycle thefts is appalling. This has a huge impact on motorcyclists by drastically increasing insurance premiums and reducing deductables; and on Londoners in general through increased crime, criminals posing a danger to the public through reckless riding on pavements and through red lights. Stolen motorcycles and other powered two wheelers are also used as a mode of committing other crimes against Londoners. This can be combated by making motorcycle theft a priority for the Met Police and giving them the proper resources to investigate motorcycle crime and offenders. Giving the police the authority to chase criminals on stolen bikes without fear of the risk to the criminal. Installing sufficient anchor points for motorcycles to be securely locked to in town. On a national level, the sentencing guidelines for motorcycle theft need to be changed and minimum sentences increased to act as an effective deterrent. Petty theft under California Law is theft of property where the value of the property is under $950 and it's taken from somebody with no intent to give it back. What's the difference between petty theft and grand theft? The difference between petty theft and grand theft basically comes down to the value of the property taken; when the value of property is over $950, it's considered grand theft. That can make the difference between a case being charged as a felony or a misdemeanor. What is the punishment for petty theft? Petty theft, like most misdemeanors, is punishable by a maximum sentence of six months in the county jail, payment of restitution and some fines. In the grand scheme of things, petty theft is not the biggest deal in the world in criminal law, however, one thing that most of my clients find disturbing about theft related offenses is that they are considered crimes involving moral turpitude. When people who have convictions for petty theft are looking for jobs or promotions, employers see the conviction as a big red flag. What does the prosecution look at? Prosecutors look at a lot of things with theft; the value of the property being taken, the prior convictions that a suspect might have, and the type of theft that might have taken place (such as embezzlement vs. taking something out of a store). Petty theft is not always theft from a retail store. Sometimes it can take place between individuals. A lot of times there are ulterior motives and other things that aren't being told in police reports, such as something to do with a debt that was owed or drug deals. Being a defense attorney in that type of situation can be all about flushing out exactly what's going on in the situation, highlighting it to the prosecution and the judge and showing that no crime actually took place, that there are false accusations being made against my client. How do you defend against petty theft? One of the most common defenses that can be utilized when helping clients accused of petty theft is the intent aspect. In order for the prosecution to sustain a conviction, they basically have to show that the person had the intent to permanently deprive the rightful owner of the property. Sometimes I can show that my client was distracted, stressed out, that there was some sort of misunderstanding between loss prevention (or store or rightful owner) and my client, which caused them to think they were being stolen from, when in fact my client may have stepped outside of the store to use the phone or was just distracted with kids. With petty theft, it's really kind of an interesting crime. People from all walks of life and sometimes really really great and hardworking people will come in. People with families who are really involved in the community. In some cases there's video surveillance, or there's admissions that make legally defending a petty theft case very difficult. Sometimes it's clear based on the evidence that we receive from the prosecution that -- most likely -- going to trial or filing a motion is not going to be successful. In those types of cases, sometimes we can highlight my client's background and convince the prosecution and the judge to allow my client to participate in a diversion program. Diversion programs entail completing a petty theft class, doing some community work service, maybe paying restitution to the victim. If all those things are done in a timely manner, sometimes I can get the prosecution to dismiss the case or reduce it to another type of charge which doesn't reflect theft which is better for future job opportunities.
